POSH Act Compliance Requirements for Employers in India

In most organisations, POSH compliance is done only when the employee files a written complaint or when the annual report is requested by the District Officer. This is when the missed IC appointments and lack of training are known. In the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, these are not ideal practices; they are mandated practices. As per the legislation, the employer should have already put in place the mechanism for prevention and redressal of any such issue beforehand.

Who Must Comply With the POSH Act?

This Act extends to all organisations in India, be it firms, startups, LLPs, shops, hospitals, educational institutions, NGOs, and government organisations. This Act includes all women workers in the organisation, whether employees, contractors, interns, trainees, or visitors.

In case any office/branch employs 10 or more persons, an Internal Committee needs to be constituted by the employer. If it has fewer than 10, the complaint must go to the Local Committee notified by the District Officer. Small headcount does not exempt an employer from having a policy and informing employees about the mechanism.

How to Constitute a Valid Internal Committee

A frequent reason for an inquiry being set aside is an invalid committee. The composition is prescribed under Section 4.

Essential Requirements

●       Presiding Officer: A woman employed at a senior level in that workplace

●       Two employee members: With experience in social work or legal knowledge or commitment to the cause of women

●       One external member: From an NGO or association working for women's cause, or a person familiar with issues of sexual harassment. This is mandatory.

At least 50% of members must be women; tenure is 3 years

The external member should get fees and allowances as per the guidelines provided in the rules. It is common practice in most organisations to monitor the dates for renewal, training, and display through an internal tracker, usually in the form of a POSH compliance checklist for employers in India.

Common Errors That Invalidate the IC

●       Nominating a junior employee as Presiding Officer for convenience

●       Not appointing an external member or not paying prescribed fees

●       Having the same person on multiple location ICs without formal appointment

●       Not communicating IC contact details at conspicuous places

What Are Your Prevention and Awareness Duties?

Forming the committee is just the first step. It is the responsibility of the employer to ensure that there will be no sexual harassment in the organisation and ensure that employees know about the procedure to report such complaints.

Policy and Communications

A written policy should exist for sexual harassment as per Section 2(n) and the procedures to make complaints as per Section 16.

Names of Internal Committee members to be put on notice in prominent places and included in employee handbooks and induction.

State penal consequences and protection against retaliation clearly

Training and Documentation

●       Conduct workshops for all employees at regular intervals

●       Provide orientation to Internal Committee members on inquiry procedure, evidence handling, and principles of natural justice

●       Maintain proof - attendance sheets, content decks, photographs

Labour inspections now ask for this proof. A generic one-time email is not treated as compliance. These measures constitute an important component of the employer’s legal duties under the POSH Act, which includes maintaining a safe work environment, offering help in case the complainant wants to file an FIR, and making sure that there is no victimisation in case of a complaint.

Annual Filing, Inquiry Time Frame and Documentation

After receiving a complaint, the time frame and procedure are clearly defined.

How a Complaint Inquiry Should Run

●       Complaint in writing within 3 months of the incident, extendable by another 3 months for reasons recorded in writing

●       Internal Committee to complete inquiry within 90 days and submit report within 10 days to employer

●       Employer to act on recommendations within 60 days

●       Both parties to be heard, confidentiality to be maintained, and no publication of identities

●       Conciliation is allowed only at the request of the complainant, and monetary settlement cannot be the basis for conciliation.

Records and Annual Report

●       Mention the minutes of meeting, complaints, evidence, and investigation report

●       Submit Annual Report to District Officer every year with information regarding complaints made, settled, pending and workshops conducted

●       Disclose the number of complaints made in the Board’s report under the Companies Act wherever applicable

In the case of organisations having hybrid working, multiple office setup, or deployment in client sites, ensuring uniformity of sexual harassment workplace compliance in India mandates a committee per location above 10 strength, a common policy, and that online harassment during work through call/message/virtual meeting is also treated as workplace.

Points Often Missed in Audits

Can Employer Initiate Inquiry Suo Moto?

Under POSH, the inquiry starts on a written complaint by the aggrieved woman. The Act does not provide for suo moto initiation by the employer. However, if the employer learns of a serious incident, it is expected to assist the aggrieved woman to file a written complaint and ensure interim measures, and may also initiate separate action under service rules if applicable.

Is POSH Compliance Part of Investor Due Diligence?

Yes. Investors, acquirers, and statutory auditors today consider the constitution of Internal Committee, annual reports, training record, and policy communication as a part of the diligence process for governance and labour laws compliance. In case of non-compliance, there have been conditions in deals and remedial actions.

Penalties for Non-Compliance

As per Section 26, non-constitution of Internal Committee, not acting on recommendations, or filing of Annual Report may incur a penalty of up to Rs. 50,000. Repeated offences may incur double penalty and may lead to cancellation or non-renewal of license/registration for carrying on business.

FAQs

Is work from home covered under POSH Act?

Yes. “Workplace” means any place visited by an employee while he/she is employed or during the course of employment, including a vehicle provided by the employer and a virtual workplace.

What if our organisation has fewer than 10 employees?

You will still need to have a policy in place and display penal consequences. Employees must be informed that complaints will be taken up by the Local Committee.

Can anonymous complaints be inquired into?

The Act requires a written complaint by the aggrieved woman. Anonymous complaints cannot be formally inquired into under POSH, though employers may look into them under their own service rules.

Steps to Close Gaps Now

Audit your committee for legal validity, update member details and external member agreement, ensure the policy is accessible with acknowledgement, schedule annual awareness and IC training, and file the annual report with the District Officer on time. Using updated templates without checking current legal requirements often creates more gaps than it closes.
